Your assignment is to write a letter
responding to the hypothetical situation outlined below. You will only meet the BWAC
requirement by completing this assignment. More detailed instructions follow the fact
pattern.
You spend a lot of time at your romantic partner’s rent-stabilized apartment on the
Upper East Side of Manhattan. However, you also own a co-op on the Upper West
Side. You consider yourself a temporary resident or guest at your partner’s
apartment.
Your partner’s landlord is claiming that your partner’s apartment is, in fact, your
primary residence. He contends that your income should be added to your partner’s
to determine whether the two of you exceed the maximum allowed for her
apartment to remain rent-stabilized. If your partner’s apartment is destabilized, the
rent will rise enormously.
You maintain that your own apartment is your primary residence. For that reason,
you do not rent it out. Therefore, you believe the landlord is incorrect. Whether an
apartment is a person’s primary residence turns on the person’s physical presence
on an ongoing, substantial basis.
Write a letter to your partner’s landlord explaining your position.
Do not omit relevant and important facts; do not include any facts
which are not mentioned in this assignment.
Your tone should be factual and non-apologetic. Do not copy text from the
